A Disputed Escape of Water Claim Successfully Resolved

An escape of water from a flat above caused extensive damage to a residential property, breaking through the ceilings of the kitchen and living room before tracking down through the walls and into the flooring below. What initially presented as surface-level damage quickly revealed itself to be far more serious, with moisture embedded deep within the structure.

Jon Wood of Aspray East Barnet & St. Albans was appointed to manage the claim and support the policyholder through what was already a highly stressful period for their family. Despite initial pushback from the loss adjuster, persistent negotiation, technical validation, and careful handling of the policyholder’s circumstances meant the claim was ultimately agreed in full, allowing the property to be properly restored and the family to regain stability.

When Property Damage Compounds with Vulnerability

The claim arose after water had escaped from a neighbouring flat above, coming through the ceilings of the kitchen and living room before travelling down through the walls and into the flooring below. By the time the damage was assessed, moisture had spread into the kitchen and hallway floors, affecting both the visible finishes and the underlying structure.

At the time, the policyholder was managing ongoing health conditions, including heart complications and diabetes, alongside complex mental health difficulties. During the course of the claim, she was also preparing for surgery in London.

Her husband was balancing the situation while continuing to run his business, and their young daughter was staying with grandparents in the Midlands. The disruption caused by the property damage added significant strain to an already difficult situation.

When Unseen Damage Occurs

The primary challenge was securing agreement on the correct scope of works. In order to properly dry the building fabric and sub-floor, a full strip-out was required. This is often where claims become contentious, as the extent of hidden damage is not always immediately visible but must still be addressed to prevent long-term issues.

The loss adjuster initially pushed back on the need for a full kitchen strip-out and the extent of drying required. Without this being approved, there was a real risk that the property would be inadequately restored, leaving residual moisture within the structure and creating future problems.

At the same time, the claim needed to be handled with sensitivity. The policyholder was not in a position to manage a prolonged dispute or coordinate multiple moving parts while dealing with her health and family responsibilities.

Without intervention, this claim could easily have stalled, leaving the property in limbo and the family without a clear path forward.

Our Approach

With Aspray taking full control of the claim, they were able to take over managing both the technical argument and the practical realities facing the policyholder. A clear and detailed scope of works was prepared, outlining the necessity of fully stripping the kitchen to allow proper structural drying of the masonry and sub-floor.

When the loss adjuster resisted this scope, Aspray continued to challenge the position and pushed for independent validation. This resulted in the appointment of a surveyor to provide a second opinion.

The surveyor fully endorsed Aspray’s proposed scope, confirming that the extent of the works was justified. This proved to be the turning point in the claim, removing any ambiguity and forcing agreement from the insurer.

Creating Breathing Room for the Family

Alongside the technical negotiations, the practical reality of the family’s situation had to be addressed.

A cash settlement for alternative accommodation was secured, giving the policyholder’s husband the flexibility to manage hotel stays around hospital visits in London, family commitments in the Midlands, and the ongoing demands of his business.

The claim took approximately two months to reach agreement, but throughout that period Aspray handled all communication, escalation, and coordination, ensuring the policyholder was not left to manage the process alone.

The Outcome

The kitchen was fully stripped back, allowing for proper structural drying before reinstatement began. Flooring throughout the affected areas was replaced, and the property was restored and redecorated to a high standard.

The end result was not just a repaired home, but one finished to a level that met the policyholder’s expectations and needs.
